MetaHoof Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and ANP LABS TECNOLOGIA LTDA ("ANP Labs," "we," "our," or "us") regarding your access to and use of the MetaHoof platform, including any website, game client, user interface, application, marketplace feature, payment flow, support channel, digital item system, official automation feature, content, and related services we make available (collectively, the "Platform").

By accessing or using the Platform, creating an account, purchasing or using any digital item or virtual currency, linking any third-party account, or otherwise participating in MetaHoof, you agree to these Terms. If you do not agree, you must not access or use the Platform.

1. Eligibility and Access

You may use the Platform only if you:

• are at least 18 years old, or the age of legal majority required to use the Platform in your jurisdiction, whichever is higher;
• have legal capacity to enter into a binding agreement;
• are not prohibited from using the Platform under any applicable law, sanction, restriction, or regulatory rule; and
• comply with these Terms and all applicable laws.

You are solely responsible for determining whether your use of the Platform is lawful where you access it. ANP Labs may restrict, refuse, suspend, or terminate access in any jurisdiction, for any user category, or for any device, network, payment method, or sign-in method, at any time and without liability to you.

2. Nature of the Platform

MetaHoof is a competitive digital game with a participation-driven virtual economy. It is not:

• a bank, brokerage, exchange, money transmission service, or investment platform;
• a gambling service or wagering product;
• a promise of profit, yield, appreciation, liquidity, or recoverable value; or
• a commitment that any digital item, balance, reward, or participation right will retain utility, value, transferability, or availability.

The Platform may include official system-controlled execution features, including official in-game agents and delegated participation systems, where expressly enabled by ANP Labs. Those features remain subject to these Terms, game rules, balancing controls, and ANP Labs' enforcement discretion.

3. Definitions

For purposes of these Terms:

• Account means your MetaHoof account and any linked authentication profile, wallet profile, payment profile, or related user identity recognized by the Platform.
• Digital Item means any virtual or digital object, entitlement, access right, horse, trainer, cosmetic, blueprint, ticket, license, progression item, or similar item associated with the Platform.
• Virtual Currency means any in-game unit, balance, point, credit, or premium currency made available by ANP Labs for use within the Platform.
• Blockchain-Linked Asset means any digital item or record that ANP Labs chooses to associate with one or more blockchain environments. Blockchain linkage does not limit ANP Labs' rights under these Terms.
• Official Automation means an automation or execution feature expressly made available by ANP Labs within the Platform, subject to Platform rules and constraints.
• Unauthorized Automation means any bot, script, macro, emulator, headless client, automation framework, external orchestrator, unofficial agent, browser automation, packet manipulation tool, scraping tool, or similar mechanism not expressly authorized by ANP Labs.
• Platform Records means ANP Labs' internal books, logs, telemetry, gameplay records, enforcement records, account records, payment records, support records, state records, and other internal systems of record.

4. Account Registration, Security, and Verification

You must provide accurate, current, and complete information when creating or maintaining an Account. You must promptly update information that becomes inaccurate.

You are responsible for:

• maintaining the confidentiality and security of your credentials, devices, wallets, email addresses, and linked provider accounts;
• all activity occurring through your Account or linked credentials, whether or not authorized by you; and
• immediately notifying ANP Labs if you suspect compromise, unauthorized access, fraud, or misuse.

ANP Labs may require you, at any time and in its sole discretion or reasonable determination, to verify:

• identity;
• age;
• jurisdiction;
• source of funds;
• payment method ownership;
• wallet control;
• device or network association; or
• any information relevant to fraud prevention, compliance, security, or Platform integrity.

We may deny, delay, suspend, or terminate access pending review, and we may rely on third-party verification providers. Failure to cooperate may result in account restriction or closure.

5. Limited License; Ownership of the Platform

Subject to these Terms, ANP Labs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for lawful, personal, non-commercial entertainment purposes.

Except for this limited license, ANP Labs and its licensors retain all right, title, and interest in and to:

• the Platform;
• all software, code, systems, databases, simulations, balancing logic, content, artwork, audio, text, interfaces, and branding;
• all game rules, economies, mechanics, standings, rewards, and state systems; and
• all derivatives, modifications, and improvements.

No Digital Item, Virtual Currency, Blockchain-Linked Asset, or Account grants you any ownership interest in the Platform or any intellectual property rights, except to the limited extent expressly stated in these Terms.

6. Digital Items, Virtual Currency, and Blockchain-Linked Assets

6.1 General Nature

Digital Items and Virtual Currency are licensed, limited-use digital rights made available within the Platform. They are not deposits, stored value, securities, property interests in ANP Labs, or obligations to redeem for money, goods, or services outside the Platform.

6.2 Account-Bound and Blockchain-Linked Treatment

Some Digital Items may be account-bound, some may be Blockchain-Linked Assets, and some may include both Platform and external state components. In all cases:

• Platform access, utility, functionality, and eligibility are governed by ANP Labs and the Platform;
• ANP Labs may require Platform recognition, synchronization, validation, locking, or state confirmation before any item can be used;
• Platform Records govern how items are treated within MetaHoof, subject to applicable law; and
• blockchain visibility or transferability does not guarantee in-Platform recognition, access, utility, or eligibility.

6.3 No Guarantee of Value or Availability

ANP Labs makes no promise that any Digital Item, Blockchain-Linked Asset, or Virtual Currency will:

• maintain value or utility;
• be continuously usable;
• remain transferable;
• remain compatible with third-party services;
• remain available after updates, balancing changes, suspensions, discontinuations, or enforcement actions; or
• be immune from modification, disabling, restriction, blacklisting, or invalidation.

6.4 Platform Control

To protect fairness, security, compliance, and the game economy, ANP Labs may at any time:

• create, modify, reclassify, rebalance, replace, suspend, disable, lock, restrict, delist, or discontinue any Digital Item or Virtual Currency;
• alter item attributes, utility, eligibility, performance, rarity, progression, or participation rights;
• separate, merge, remap, or invalidate item states;
• prevent use of any asset associated with misconduct, abnormal activity, disputes, suspected fraud, technical errors, or economy harm; and
• render any item, asset, balance, or participation right unusable within the Platform.

7. Payments, Fees, Refunds, and Chargebacks

7.1 Payments and Fees

The Platform may offer paid content, Digital Items, Virtual Currency, entries, upgrades, passes, and other services. Prices, taxes, fees, availability, and payment methods may vary by region, provider, and time, and may change at any time without prior notice.

Payments may be processed by third-party providers, storefronts, payment processors, or platform operators. ANP Labs does not control all third-party payment systems and is not responsible for their acts, omissions, delays, reversals, compliance decisions, or outages.

7.2 Finality

Except as required by applicable law, all purchases, fees, entries, and consumptions are final, non-refundable, and non-reversible once submitted, fulfilled, consumed, credited, or otherwise recognized by the Platform or applicable provider.

You are responsible for reviewing all transaction details before confirming a purchase. Mistaken purchases, dissatisfaction with balancing changes, item performance, utility, eligibility, or race outcomes do not entitle you to reversal, refund, or compensation.

7.3 Errors and Mispricing

ANP Labs may refuse, cancel, reverse, or correct any transaction, fulfillment, listing, balance, reward, or item state resulting from:

• system error;
• display error;
• pricing error;
• synchronization failure;
• payment or provider error;
• duplicate crediting;
• abnormal activity; or
• human mistake.

ANP Labs may reclaim or invalidate mistakenly delivered items, balances, access, rewards, or rights, and may restrict the associated Account while reviewing the issue.

7.4 Chargebacks and Payment Disputes

If you initiate a chargeback, payment reversal, unauthorized-payment claim, or similar dispute, ANP Labs may, to the fullest extent permitted by law:

• suspend or restrict your Account immediately;
• freeze, disable, or invalidate related Digital Items, balances, entries, rewards, or participation rights;
• deny further purchases or participation;
• offset disputed amounts against any balances or rights associated with your Account; and
• report the matter to payment providers, fraud systems, and law enforcement where appropriate.

ANP Labs may maintain restrictions during and after dispute review and is not required to restore access even if a payment provider reaches a different determination.

8. Rules of Conduct

You must not use the Platform in any manner that is unlawful, abusive, unfair, deceptive, harmful to the Platform, harmful to other users, or harmful to the game economy.

Without limitation, you must not:

• engage in fraud, deception, impersonation, identity abuse, or payment misuse;
• use multiple Accounts, mule Accounts, nominee Accounts, shared Accounts, rented Accounts, or coordinated Accounts to obtain unfair advantage or evade restrictions;
• collude, cooperate, coordinate, or signal with others to manipulate races, standings, rewards, markets, matchmaking, events, distributions, or any economy mechanic;
• exploit bugs, glitches, unintended interactions, latency, sync issues, stale state, pricing anomalies, or design loopholes;
• engage in reward farming, wash activity, circular transfers, self-dealing, artificial volume creation, or resource-drain activity;
• manipulate race results, race entries, standings, rewards, item attributes, telemetry, or market activity;
• scrape, crawl, mirror, mine, monitor, or extract data from the Platform except through ordinary permitted use;
• reverse engineer, decompile, disassemble, intercept, tamper with, or otherwise probe the Platform or its communications;
• use the Platform to violate law, regulation, sanctions, or third-party rights; or
• encourage, assist, or attempt any of the foregoing.

9. Official Automation and Prohibited Automation

9.1 Official Automation

ANP Labs may make available Official Automation features, including official in-game agents or delegated participation systems. Any such feature is permitted only to the extent expressly enabled by ANP Labs and remains subject to:

• discrete-cycle execution rules;
• gameplay constraints;
• fees, energy, readiness, and eligibility rules;
• balancing adjustments;
• suspension, throttling, or disabling by ANP Labs; and
• these Terms.

Official Automation does not create any right to continuous operation, profitability, uninterrupted access, or immunity from enforcement.

9.2 Unauthorized Automation

You must not use Unauthorized Automation. This prohibition includes:

• bots, scripts, macros, browser automation, keyboard or mouse automation, and external orchestration tools;
• unofficial agents, bot frameworks, or automation wrappers;
• emulators, headless clients, modified clients, packet injectors, or traffic manipulation tools;
• scraping, monitoring, or data extraction tools designed to automate decision-making or gain unfair advantage; and
• any method intended to simulate, accelerate, amplify, or conceal user or agent activity beyond officially permitted Platform behavior.

ANP Labs may treat suspicious patterns, abnormal timing, synchronized actions, high-frequency interactions, impossible usage patterns, or telemetry inconsistent with ordinary use as evidence of Unauthorized Automation or abuse.

10. Economy Integrity, Balance, and Sustainability

The MetaHoof economy is a rule-bound game system. You acknowledge and agree that ANP Labs may take any action it deems necessary, in its sole discretion or reasonable determination, to protect:

• game balance;
• economy integrity;
• reward fairness;
• anti-inflation controls;
• anti-abuse protections;
• anti-collusion protections;
• player safety;
• service stability; and
• long-term sustainability of the Platform.

Without limitation, ANP Labs may:

• rebalance mechanics, rewards, item utility, race logic, participation rules, progression paths, fees, and costs;
• cap, throttle, queue, suspend, or restrict participation, automation, entries, rewards, or distributions;
• alter eligibility rules, classing rules, environment access, item attributes, and participation conditions;
• remove, reduce, delay, suspend, or discontinue rewards, campaigns, passes, pools, or economy components;
• reverse or void abnormal gains, standings, rewards, balances, item states, or participation rights;
• lock, disable, or blacklist assets linked to abuse, manipulation, or economy harm; and
• discontinue any feature, mode, or mechanic at any time.

You have no claim based on the existence, continuation, prior design, or future availability of any economy mechanic, item utility, balancing state, or reward pattern.

11. Source of Truth and Platform Records

Subject to applicable law, Platform Records are the authoritative source of truth for disputes, reviews, corrections, and enforcement relating to:

• Account ownership and access;
• Digital Items, Virtual Currency, and Blockchain-Linked Asset recognition within the Platform;
• race entries, race outcomes, standings, rewards, and participation history;
• balances, fees, purchases, and consumptions;
• eligibility, readiness, cooldowns, locks, and restrictions;
• suspected exploitation, collusion, abuse, or automation; and
• enforcement actions and related determinations.

Displayed values, user interfaces, cached data, blockchain displays, storefront displays, notifications, or third-party records may be delayed, incomplete, or inaccurate. ANP Labs may correct discrepancies at any time and is not obligated to honor erroneous displays or states.

12. Monitoring, Investigations, and Evidence Preservation

ANP Labs may monitor use of the Platform, collect telemetry, review logs, correlate related Accounts and devices, and investigate suspected misconduct, abnormal activity, fraud, security incidents, or economy harm.

In connection with any review, ANP Labs may:

• suspend first and investigate later;
• preserve logs, data, evidence, device information, payment information, and related records without notice;
• restrict access to associated Accounts, assets, devices, wallets, payment methods, IP addresses, or profiles;
• request information or documents from you and third parties; and
• share relevant information with service providers, payment processors, platform operators, regulators, and law enforcement where appropriate.

ANP Labs is not required to disclose investigative methods, evidence, thresholds, or internal enforcement criteria.

13. Enforcement Rights

If ANP Labs suspects, believes, or determines that you engaged in misconduct, abnormal activity, prohibited conduct, or behavior harmful to the Platform, other users, or the game economy, ANP Labs may, with or without notice and with immediate effect:

• warn, suspend, throttle, mute, lock, freeze, limit, or terminate your Account;
• deny access to the Platform, specific features, or specific environments;
• freeze, disable, blacklist, void, delist, remove, reclaim, or render unusable any Account, Digital Item, Blockchain-Linked Asset, Virtual Currency balance, reward, entry, pass, license, or participation right;
• invalidate, reverse, cancel, correct, or restate race results, standings, rewards, entries, balances, or item states;
• remove or delay rewards, achievements, event outcomes, or campaign entitlements;
• restrict linked devices, wallets, payment methods, IP addresses, networks, or associated Accounts;
• refuse reinstatement, refuse service, or deny future registration; and
• take any other action ANP Labs deems necessary to preserve fairness, security, compliance, or sustainability.

These rights apply whether the issue arises from proven misconduct, suspected misconduct, abnormal activity, technical exploitation, payment risk, third-party reports, or protection of the Platform.

14. Suspension and Termination

ANP Labs may suspend or terminate all or part of your access to the Platform at any time, for any reason permitted by law, including for convenience, compliance, security, inactivity, provider dependency, service discontinuation, or risk management.

On suspension or termination:

• your license to use the Platform terminates immediately to the affected extent;
• your access to Accounts, Digital Items, balances, and participation rights may be restricted, disabled, or ended;
• ANP Labs may preserve, delete, or retain data as permitted by law and operational need;
• no refund, compensation, or restoration is owed except as required by applicable law; and
• attempts to evade enforcement may result in broader restrictions across related Accounts, assets, devices, and networks.

ANP Labs may keep enforcement actions confidential where appropriate and is not obligated to offer an appeal process, explanation, or reinstatement.

15. Third-Party Services and Dependencies

The Platform may depend on third-party services, including:

• authentication providers;
• payment processors and storefronts;
• wallet providers;
• blockchain networks and infrastructure;
• cloud, hosting, analytics, security, or content delivery services; and
• fraud, compliance, or age-verification providers.

ANP Labs does not control third-party services and is not responsible for their acts, omissions, unavailability, outages, reversals, compliance restrictions, policy changes, or failures. Third-party terms may also apply to your use of those services.

If a third-party provider suspends, blocks, restricts, reverses, or otherwise affects your access or assets, ANP Labs may take related action within the Platform and shall have no liability for resulting losses, delays, or restrictions.

16. Privacy and Data Use

Your use of the Platform may involve collection and processing of gameplay, device, fraud-prevention, support, payment-adjacent, and operational data as described by ANP Labs from time to time.

You agree that ANP Labs may process, store, correlate, and disclose data as reasonably necessary to:

• operate and secure the Platform;
• investigate abuse, fraud, and misconduct;
• enforce these Terms;
• comply with law and regulatory obligations; and
• preserve the integrity and sustainability of the Platform.

ANP Labs may retain records for legal, operational, evidentiary, and enforcement purposes for as long as reasonably necessary or permitted by law.

17. Disclaimers

To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis. ANP Labs disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, title, accuracy, reliability, quiet enjoyment, and error-free operation.

Without limiting the foregoing, ANP Labs does not warrant that:

• the Platform will be uninterrupted, secure, or error-free;
• any race, event, reward, Digital Item, balance, or feature will remain available;
• any bug, exploit, or vulnerability will be corrected on any particular timeline;
• any third-party service will remain compatible or accessible;
• any displayed state, result, balance, or record will be free from delay or display error;
• any enforcement decision will be delayed pending notice to you; or
• any Digital Item, Virtual Currency, or Blockchain-Linked Asset will retain utility, functionality, or recognition within the Platform.

ANP Labs may modify, suspend, or discontinue the Platform, in whole or in part, at any time, with or without notice.

18. Limitation of Liability

To the fullest extent permitted by law, ANP Labs and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, opportunity, goodwill, data, access, digital items, virtual currency, rewards, standings, or participation rights, arising out of or related to the Platform or these Terms.

To the fullest extent permitted by law, the total aggregate liability of ANP Labs for all claims arising out of or relating to the Platform or these Terms shall not exceed the greater of:

• USD $100; or
• the total amount you paid directly to ANP Labs for use of the Platform in the ninety (90) days before the event giving rise to the claim.

These limitations apply regardless of legal theory and even if a remedy fails of its essential purpose.

Nothing in these Terms excludes liability to the extent such exclusion is prohibited by applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless ANP Labs and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents from and against any claims, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Platform;
• your breach of these Terms;
• your violation of law or third-party rights;
• your fraud, misconduct, abuse, automation, collusion, manipulation, or circumvention;
• your Digital Items, Blockchain-Linked Assets, transfers, or external transactions; or
• any dispute involving your Account, payment method, wallet, device, network, or content.

ANP Labs may control the defense and settlement of any matter subject to indemnification, and you will cooperate fully.

20. Intellectual Property and Feedback

All Platform intellectual property belongs to ANP Labs or its licensors. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, sell, license, or exploit any Platform content except as expressly authorized in writing by ANP Labs.

If you provide ideas, feedback, suggestions, reports, creative input, or other submissions relating to the Platform, you grant ANP Labs a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable right to use, modify, reproduce, distribute, display, perform, and otherwise exploit them for any purpose, without compensation or attribution.

21. Governing Law and Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to the Platform or these Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles.

Before filing formal proceedings, you agree to attempt to resolve the matter informally by contacting [email protected] and allowing ANP Labs at least thirty (30) days to review the issue.

Subject to applicable law, the courts of Curitiba, Paraná, Brazil shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Platform, and you irrevocably submit to that jurisdiction and venue.

Nothing in these Terms limits ANP Labs' right to seek injunctive, equitable, protective, or emergency relief in any competent jurisdiction.

22. General

22.1 Changes to the Terms

ANP Labs may modify these Terms at any time by posting updated Terms or otherwise providing notice as ANP Labs deems appropriate. Changes take effect when posted or on the date specified by ANP Labs. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

22.2 Assignment

You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without ANP Labs' prior written consent. ANP Labs may assign or transfer these Terms, in whole or in part, without restriction.

22.3 Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law. No waiver by ANP Labs is effective unless in writing, and no failure to enforce any provision constitutes a waiver.

22.4 Entire Agreement

These Terms, together with any additional policies, rules, or notices expressly incorporated by reference, constitute the entire agreement between you and ANP Labs regarding the Platform and supersede prior or contemporaneous understandings on that subject.
